Terms and Conditions of Use

1) Introduction

By using DamyxIA, you agree to these Terms and Conditions. If you do not agree, do not use the Service. DamyxIA is a SaaS platform that combines AI image generation, creative project management, and autonomous engineering assistance in a single web environment accessible from any modern browser. These Terms govern the contractual relationship between DamyxIA Inc. and each end user, whether a consumer or a professional, and apply to both the free plan and the Premium plan.

2) Who we are

DamyxIA is an AI SaaS platform operated from New York, United States. Our team designs, develops, and continuously maintains a product built for creators, educators, small businesses, and technical teams that need speed, order, and visual quality without depending on complex workflows. 3) Minimum age

You must be at least 18 years old to use DamyxIA. Upon registration the user declares under their own responsibility that they meet the age of majority required by the State of New York and by their country of residence. DamyxIA reserves the right to suspend accounts when there are reasonable indications that this requirement is not met.

4) User account

You are responsible for maintaining the confidentiality of your account, password and all activity under it. We recommend strong passwords, not sharing credentials and signing out from third-party devices. DamyxIA applies automatic lockouts on suspicious attempts and offers safe recovery flows through the verified email of the account owner.

5) User content

Images, files, prompts and data uploaded or generated by the user belong to the user. DamyxIA does not claim rights over them and does not use them to train its own models. You retain ownership of your works and freely decide whether to download, share or delete them. DamyxIA only stores them to provide the contracted service.

6) Permitted use

You agree not to use DamyxIA for illegal, harmful, fraudulent or rights-violating activities. It is forbidden to generate child sexual content, hate speech, identity impersonation, spam, malware or any use contrary to applicable local, federal or international laws. Any breach enables immediate suspension of the account.

7) Technical limitations

The service may experience interruptions, usage limits, scheduled maintenance and technical changes required to preserve platform quality. DamyxIA will notify in advance whenever maintenance is foreseeable and will avoid degradations during peak usage hours whenever possible.

8) Free and Premium plans

The Free plan has usage limits (monthly images, daily messages and basic features). The Premium plan offers expanded capabilities, access to advanced tools, higher retention and recovery of deleted content. Up-to-date details are always shown on the official pricing and benefits page within the application.

9) Payments and subscriptions

Payments are processed through Stripe using credit card, debit card or equivalent methods supported by the provider. The Premium subscription renews automatically at the start of each billing cycle unless cancelled in advance. The user may cancel at any time from the account settings panel.

10) Refunds

Refunds are not guaranteed. Stripe does not process automatic refunds and each case will be individually evaluated by DamyxIA when a justified reason exists (for example, verifiable duplicate charges or technical errors). Requests are handled at manager@damyxia.com.

11) Trash and recovery

Deleted items are retained for 30 days. Free: $0.50 per item or $3 for 7-day unlimited access. Premium: full access at no cost. Once the retention period expires, content is irreversibly erased from our systems and backups.

12) Intellectual property

The code, design, brand, logos and visual experience of DamyxIA are the exclusive property of its owner. Reproduction, reverse engineering, unauthorized revenue-sharing or any commercial use of our assets without prior written permission is forbidden.

13) Limitation of liability

DamyxIA does not guarantee accuracy of AI-generated results. The user is solely responsible for the use, publication or commercialization of results. In no event will DamyxIA be liable for indirect damages, lost profits or losses derived from the use of the Service, to the extent permitted by applicable law.

14) Jurisdiction

These terms are governed by the laws of the State of New York, United States. Any dispute shall be submitted to the competent courts of that state, without prejudice to non-waivable rights granted by consumer legislation in the country of residence of the account holder.

15) Modifications

We may update these terms at any time. When changes are substantial, a new explicit acceptance will be requested from the user. Continued use of the Service after an update implies acceptance of the current version published on this page.
